Minimum wage

Starting from 13 January 2021, the minimum wage in Romania is of RON 2300 (approx. EUR 470), not including bonuses or other additional payments.

The minimum guaranteed salary for the staff assigned to positions for which the level of higher education is required, with a minimum of 1 year of experience in the field of higher education remains the same as in the previous year. For such employees, the minimum gross monthly salary guaranteed at national level is of RON 2,350 (approx. EUR 480).

As an exemption, for the employees from the construction field, the minimum gross salary is RON 3,000 and special provisions are applied based on the Romanian legislation in force.

Legal working hours

The working day has 8 working hours and the week, 5 days (40 hours per week). The maximum working time in a week cannot surpass 48 hours, including overtime. For the work performed in excess, the employee is entitled either to free paid hours, or to an allowance.

Minimum number of days/hours off:

  • Employees are entitled to a rest period no shorter than 12 consecutive hours between two working days. The required weekly rest period is 48 consecutive hours, normally on Saturday and Sunday
  • Public Holidays

The Labor Code provides the following public holidays:

  • 1 and 2: New Year
  • Jan 24: Unification Day
  • Good Friday
  • The 1st and 2nd days of Easter
  • May 1: Labor Day
  • June 1
  • The 1st and 2nd days of Pentecost
  • 15: St Mary’s Day
  • 30: Saint Andrew’s Day
  • 1: National Day
  • The 1st and 2nd days of Christmas

Breaks

Employees working six hours or more in a day are entitled to meal and rest breaks, the length and timing of which are determined by collective bargaining agreements.

Leave

The annual leave shall have a minimum length of 20 working days.

If the employee, for justified reasons, cannot perform the annual leave in the respective calendar year, the employer is obliged to grant the leave that was not taken in a period of 18 months starting with the year following the one in which the right to annual leave was born.

The compensation in money of the leave not taken shall only be allowed at the cessation of the individual employment contract.

Notification requirement as per the Posted Workers Directive

Undertakings established in the territory of a Member State other than Romania or in the territory of the Swiss Confederation which post workers to undertakings in the territory of Romania are required to submit a notification on the transnational posting of workers, in Romanian language, to the territorial labour inspectorate under whose jurisdiction they are going to operate within at least one working day before starting work.
